Cap Fi Capital and its affiliates (“Cap Fi,” “Company,” “us,” “our,” or “we”) is a commercial finance brokerage that arranges equipment financing, working capital, term loans, SBA financing, commercial real estate financing and related products for businesses nationwide. This Privacy Policy describes the types of information we may collect from you, or that you may provide, when you visit capficapital.com and any of our sub-domains, the secure client portal and other web-connected services (collectively, the “Website”), and our practices for collecting, using, maintaining, protecting and disclosing that information.
This policy applies to information we collect on the Website, in email, text and other electronic messages between you and us, and through the secure client portal. Unless otherwise stated, it does not apply to information collected offline or by any third-party website we do not operate.
Please read this policy carefully. We may update it from time to time; the current version is always posted on this page.
II. Information we collect about you
Personal Information. We collect information by which you may be personally identified, such as name, business name, postal address, email address, telephone number, and — only where you specifically authorize a credit review — Social Security number and other identifiers required to request that report.
We collect Personal Information directly from you, for example:
- Information you provide by filling in forms on the Website, including contact requests, financing requests and lender partnership requests.
- Documents you upload to the secure client portal, such as bank statements, tax returns, identification and equipment quotes.
- Business details such as entity type, time in business, revenue, and the amount and purpose of the financing requested.
- Electronic signatures and signature records you create in the portal.
- Records and copies of your correspondence with us, including email and text messages.
III. Automatically collected data
When you browse the Website we may automatically collect information that does not by itself identify you, such as pages visited, referring pages, browser and device type, operating system, approximate location derived from IP address, and dates and times of access. We use this information to administer and secure the Website and to understand how visitors use it.
Analytics cookies are set only after you accept them in the cookie banner shown on your first visit. If you decline, no analytics tracking is loaded.
IV. How we use your personal information
We use the information we collect to:
- Respond to your inquiry and evaluate financing options for your business.
- Prepare and submit your file to lenders, funding sources and their underwriters.
- Verify your identity and, where authorized, obtain a credit review.
- Create and administer your secure client portal account and store documents you upload.
- Communicate with you about your transaction, including status updates, offers and terms.
- Send you marketing or educational messages, which you may opt out of at any time.
- Operate, secure, troubleshoot and improve the Website.
- Comply with legal, tax, regulatory and lender record-keeping obligations.
V. How we disclose your personal information
As a commercial finance brokerage, our core service is presenting your request to lenders. By submitting a request or an application, you authorize Cap Fi to share the information and documents you provide with lenders, funding sources, underwriters and other financing partners for the purpose of obtaining offers for you.
We also share information with service providers who help us operate the business, including hosting, storage, email delivery, scheduling, analytics and customer relationship management providers. These providers may access information only as needed to perform services for us.
We may disclose information to comply with applicable law, regulation, subpoena or other legal process; to enforce our agreements; to protect the rights, property or safety of Cap Fi, our clients or others; and in connection with a merger, financing, acquisition or sale of all or part of our business.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
VI. Cookies and similar technologies
Essential cookies are required for the Website and secure client portal to function, including sign-in and security. Analytics cookies help us understand aggregate usage and are loaded only with your consent.
You may block or delete cookies through your browser settings. Some parts of the Website, including the client portal, may not function normally if you do.
VII. Your choices
You may ask us what information we hold about you, ask us to correct it, or ask us to delete your portal account and the documents associated with it. You may opt out of marketing messages at any time by replying to any message or contacting us using the details below.
Some information must be retained to satisfy legal, tax and lender record-keeping requirements even after an account is closed.
VIII. Credit inquiries
We request a credit review only where you have authorized it. Credit authorization is captured separately from other portal information. Sensitive identifiers submitted for that purpose are stored in encrypted form and are not displayed back in the client portal.
IX. Security
We maintain administrative, technical and physical safeguards designed to protect the information you provide, including encrypted transmission, encrypted storage of sensitive identifiers, private document storage with access limited to your own account, and role-based access controls for our staff.
No method of transmission or storage is completely secure. You are responsible for keeping your portal password confidential and for any activity under your account.
X. Retention
We keep application information and documents for as long as needed to service your relationship with us and to satisfy legal, tax, regulatory and lender record-keeping requirements, after which we delete or de-identify them.
XI. Use of the Website by underage individuals
The Website is intended for business use and is not directed to individuals under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
XII. Do Not Track signals
Because no common industry standard for Do Not Track browser signals has been adopted, the Website does not currently respond to them. Analytics remain off unless you accept analytics cookies.
XIII. State-specific privacy rights
Residents of California, Colorado, Connecticut, Virginia, Utah and other states with comprehensive privacy laws may have the right to request access to the personal information we hold about them, request correction or deletion, request a copy in a portable format, and appeal a denied request.
We do not sell personal information or share it for cross-context behavioral advertising, so no opt-out of sale or sharing is required. We will not discriminate against you for exercising any privacy right. To make a request, contact us using the details below; we may need to verify your identity before responding.
XIV. Amendments to this policy
We may update this policy as our services change. Changes take effect when posted on this page, and the “last updated” date above will reflect the most recent revision. Your continued use of the Website after a change constitutes acceptance of the updated policy.
